Platform Role Disclaimer

Bookly.fit is a technology platform that connects trainers and clients.

We do not provide fitness, medical, health, or training services. We do not organize, supervise, or control training sessions.

Any agreement, interaction, or activity between a trainer and a client takes place solely between those parties.

Bookly.fit is not responsible for:

• the quality, safety, legality, or outcome of any training session;
• injuries, accidents, or health issues occurring during or after sessions;
• trainer qualifications, certifications, or compliance with local laws.

Health Disclaimer

Physical activity involves inherent risks.

Clients are solely responsible for ensuring that they are medically and physically fit to participate in any training session.

Bookly.fit does not assess, monitor, or guarantee the health suitability of any trainer or training session.

Participation in any activity is at the user's own risk.

Cancellations and Changes

All cancellation, rescheduling, refund, and no-show policies are defined by individual trainers.

Bookly.fit is not responsible for:

• session cancellations or changes;
• trainer availability;
• refunds or disputes related to missed sessions.

Any disputes must be resolved directly between the trainer and the client, unless otherwise required by law.

Limitation of Liability

To the maximum extent permitted by law, Bookly.fit shall not be liable for:

• personal injury, illness, or death;
• property damage;
• financial losses arising from cancelled or modified sessions;
• disputes between trainers and clients;
• any acts or omissions of trainers or clients.

Bookly.fit's total liability, if any, shall not exceed the amount paid to Bookly.fit for use of the Service.

Platform Communications

The Platform may send transactional emails related to bookings, memberships, payments and account activity.

By using the Platform, users agree to receive such communications. Users are responsible for maintaining an accurate and valid email address.

Payment Responsibility

Bookly.fit provides a platform that enables trainers and clients to arrange bookings and memberships.

The Platform does not process payments and is not a party to financial transactions between users and trainers.

All payment obligations, refunds, and disputes are the sole responsibility of the trainer and the client.

Payment status is based on information provided by the trainer.

User Communications

Users are solely responsible for the content of messages exchanged through the Platform.

Bookly.fit does not actively monitor private communications but reserves the right to review messages where required by law or to investigate violations of these Terms.

Terms

1. Introduction. Welcome to Bookly.fit ("we", "our", "us"). Bookly.fit is an online platform that allows users to discover, book, and manage fitness and training sessions, and allows trainers to publish and manage their services. By accessing or using our website or services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
2. Eligibility. You must be at least 18 years old to use the Service. By using the Service, you confirm that you are legally capable of entering into a binding agreement and that all information you provide is accurate and up to date.
3. Accounts. To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Trainers and Clients. Bookly.fit acts as a platform only. Trainers are solely responsible for the accuracy of their profiles, schedules, prices, and provided services. Clients are responsible for verifying that a trainer and session meet their expectations and health requirements. We are not a party to the agreement between trainers and clients.
5. Payments. Payments may be processed via third-party payment providers. We do not store full payment card details. Refunds, cancellations, and no-show policies are defined by individual trainers unless stated otherwise.
6. Acceptable Use. You agree not to use the Service for unlawful purposes, upload false, misleading, or harmful content, attempt to gain unauthorized access to our systems, or interfere with the operation or security of the Service.
7. Intellectual Property. All content on the Service (excluding user-generated content) is owned by Bookly.fit or its licensors. You may not copy, distribute, or exploit any part of the Service without prior written consent.
8. Termination. We may suspend or terminate your access to the Service at any time if you violate these Terms or applicable laws. You may stop using the Service at any time.
9. Disclaimer. The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation of the Service.
10. Limitation of Liability. To the maximum extent permitted by law, Bookly.fit shall not be liable for indirect or consequential damages, loss of data, income, or profits, or disputes between trainers and clients.
11. Changes to Terms. We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
